The demand for Texans to be allowed to vote on the issue in 2023 was one of many measures adopted in the Texas GOP’s party platform following last week’s state convention in Houston.

Under a section titled “State Sovereignty,” the platform states: “Pursuant to Article 1, Section 1, of the Texas Constitution, the federal government has impaired our right of local self-government. Therefore, federally mandated legislation that infringes upon the 10th Amendment rights of Texas should be ignored, opposed, refused, and nullified.

“Texas retains the right to secede from the United States, and the Texas Legislature should be called upon to pass a referendum consistent thereto.”

In another section on state governance, the platform states that Texas Republicans want the state Legislature to pass a bill in its next session “requiring a referendum in the 2023 general election for the people of Texas to determine whether or not the State of Texas should reassert its status as an independent nation.”

The myth that Texas can secede from the U.S. continues because of the state’s history of independence, according to The Texas Tribune. Texas declared independence from Mexico in 1836 and spent nine years as its own nation before becoming a U.S. state. Texas then seceded from the Union in 1861 before being readmitted following the end of the Civil War in 1870.

The U.S. Constitution makes no provision for states to secede and in 1869, the Supreme Court ruled in Texas v. White that states cannot unilaterally secede from the Union.

“If there was any constitutional issue resolved by the Civil War, it is that there is no right to secede,” the late Justice Antonin Scalia once wrote.

Still, modern secessionist efforts have continued in the state for decades—and calls to secede tend to become louder when a Democrat is a president, according to the Tribune.

It’s not clear how popular the effort is among Texans, but the Texas Nationalist Movement’s website claims almost half a million Texans support its work to “make Texas an independent nation again.”

The movement’s efforts have been promoted by Texas Republicans. Last year, state Representative Kyle Biedermann introduced a bill that called for a “Texit” referendum, which was endorsed by Texas GOP chairman Allen West. The bill ultimately failed.

The bill was rebuked by lawmakers on both sides of the aisle, with Republican state Representative Jeff Leach branding it a “disgrace to the Lone Star State” and the “very definition of seditious.”

As well as the issue of a referendum, delegates also voted on more than 270 platform planks as the convention closed on Saturday. The votes will be tallied and certified in Austin, but it is rare for a plank to be rejected, party spokesperson James Wesolek told The Tribune. He has been contacted for additional comment.

Texas Republicans also approved a resolution declaring that President Joe Biden was “not legitimately elected,” signaling the continued support for former President Donald Trump’s baseless claims of widespread fraud in the 2020 presidential election.

The Texas GOP’s new party platform also called for full repeal of the Voting Rights Act of 1965.

Other planks also indicated a further shift to the right for the party, giving prominence to culture issues. The platform describes homosexuality as “an abnormal lifestyle choice,” and also declares that the party opposes “all efforts to validate transgender identity.”

The platform also calls for a total ban on abortion and “equal protection for the Preborn.” Abortion is currently prohibited after around six weeks of pregnancy in Texas, but an imminent ruling from the U.S. Supreme Court could overturn the decision in Roe v. Wade that guaranteed abortion rights nationwide and trigger a law in Texas making abortion illegal.

The new Texas GOP platform also states that the education system should focus on “imparting essential academic knowledge, understanding why Texas and America are exceptional and have positively contributed to our world, and while doing so, also offer enrichment subjects that bless students’ lives.”

It calls for students to learn about the “Humanity of the Preborn Child,” including teaching that life begins at fertilization. It also demands that the state legislature pass a law prohibiting the teaching of “sex education, sexual health, or sexual choice or identity in any public school in any grade whatsoever.” [Newsweek]

  1. Thank you, Comentakeit. You are completely correct about what you said. As a 6th generation Texan, I can tell you I am sick to death of those we didn’t elect destroying our country. Both sides of my family were ranchers and some raised horses that they sold to the Confederates during the civil war. My grandfather fought in the civil war. Before Texas became a state, several in that side of my family were Texas lawmen who protected the settlers from Indian attacks and from renegades from Mexico. They were considered the forerunners of the Texas Rangers. I have copies of two books written by relatives in my family. Many in our family participated in the cattle drives where they drove the cattle from the southwestern part of our state up to the Panhandle. I can guarantee you that my state has all the resources we need to survive as our own country again. I had rather see us secede than stay in the Union. At my age, I hope I will be in my grave before I see this nation completely torn apart. Too old to live through the times that I know are coming.

  2. I say Texas secedes from the Union and forms its own constitution. That it calls for only legal American citizens to inhabit the State and dismisses all the illegals that live there. That it develops its own economic system with taxes, forms its own sovereign government, and services rendered to only the ones who contribute to its economy by working for a living, and paying into its own Social Security and retirement. And is to be paid to its own retirees. And no free hand outs. You must work and pay into the system otherwise you are not eligible to partake of the benefits.     You have the myths mixed up. The real myth is that there was a civil war. A civil war, by definition, is competing factions fighting for control of the government. As the Confederate States had already legally seceded, they were not fighting for control of the government, rather to keep it from attaining rights they did not have. The US Supreme Court ruling of 1869 was unconstitutional, as are the 13th, 14th, and 15th Amendments, as the former Confederate States were under occupation and under martial law, thereby not functioning as states.
    The real kicker, of course, is that the US government bombed Serbia to facilitate the breakup of Yugoslavia, claiming it was supporting democracy and the right to self determination for secession of Slovenia, Croatia, and Bosnia Herzegovina. Later, it recognized Kosovo’s declaration of independence which was made without a referendum. To suggest states within the US have no right to self determination is ridiculous. If that were true, the colonies had no right to secede from the United Kingdom. The Supreme Court decision of 1869 was a political statement, not a judicial ruling.

  14. This article is full of misinformation. There is no clause in the Constitution wherein the states ceded the right of secession. The 10th Amendment clearly states that States and the People retain ALL rights and powers not specifically granted to the Federal government. Therefore, the 10th Amendment preserves the right of ALL STATES to secede. Justice Scalia knew when he made his statement about the Civil War that constitutional issues are not decided by war. The constitution is not interpreted by war, nor amended by war. If the people want to terminate the right of cessation, it can only be done by amendment, as required in the Constitution.

  22. No problem with Texas going on its own.. BUT, to get the votes to do it, you have to have a plan that protects the ones leaving the union.

    Now how many of you will vote to leave if your Social Security is stopped? 401 K confiscated by the feds? Medicare plan gone?

    Texas would have to be able to have the funds to stop the fear of Uncle sam taking away the money. It could be covered by selling oil and gas to the world. Lease some of our gulf coast ports. The list is bigger than these items.

  26. Texas can leave the Union, here’s how. Texas had a contract with the United States to become a state. An example of part of that contract was the federal government had to follow the US Constitution, First Amendment, the federal government could not own any land but outside what the First Amendment stated. Which is why there is no BLM in Texas. In order for a contract to be legal there needs to be consideration and when Texas v White was in front of the high court there may have still been some consideration but that’s not the case today. Look at the mess created by the federal government has caused major damage to the state of Texas. And by refusing to uphold its Constitutional duty badly damaging the entire population of Texas Citizens. Zero consideration on behalf of the federal government which represents the binding of the Union. Texas is free to leave the Union and Texas v White no longer applies, like many SCOTUS rulings of the long ago past.

Texas, like every other state in the union has the right to run its own state under the general constitution the federal government only has powers within 10 sqaure miles of its center……the district of criminals……D. C., washington. Furthermore, under the constitution, the federal government’s extending powers into any given state or jurisdiction can only be done under the written agreement by that state or jurisdiction. (all the above previously, in my own simplified words)

  30. It doesn’t really matter whether the constitution addresses the right of Texas or anybody else to secede. The Federal government has walked all over the Constitution and says it’s a living document. But if the founding fathers gave the people the right to overthrow and reestablish government when it becomes abusive, then that would certainly include seceding from such an abusive Federal system, infiltrated by Americas enemies and which has no use for the Constitution anyway. The purpose of the Constitution was to tie the hands of those who would abuse their power in government. Not to tell the people what form of government they were allowed to establish for themselves.

  32. Uh … no, it’s not a myth. The people of Texas have the right, under the Texas Constitution Article 1 Section 2 to determine the type of government they are going to live under. Scalia was wrong, and the court decision in 1869 was retribution for daring to stand up to the tyrant (yes, tyrant) Lincoln and the banksters.
    Jefferson himself said if any state wished to leave the Confederacy (yes, it was called a Confederacy prior to the “union” word), then God bless them. The mythical “union” was a Hamiltonian term that was used to suppress any opposition to the federal govt. doing whatever it wanted to.

  35. The article states that the constitution doesn’t allow for the state to secede. However, this government doesn’t seem to care about the constitution or uphold it so that shouldn’t be a problem. Of course the liberal left are all hypocrites so I’m sure they’ll still act like it matters in this one instance
